These terms cover using spooled.
By making an account you agree to them. If you do not, you can still read everything public here without one.
Who you are dealing with
spooled is operated by Spooled Media. Reach us at help@spooled.me, or at privacy@spooled.me for anything about your data.
Your account
You need to be old enough to agree to these terms where you live — at least 13, and at least 16 in the UK and the EEA. One person, one account. Keep access to the email address on it, and to any Apple or Google account you sign in with, because that is how you sign in and how you prove the account is yours.
What you write stays yours
You keep every right you have in what you post. Your reviews are your reviews. We claim no ownership of them.
You give us permission to store your writing, show it on the site and in the app to the people your privacy settings allow, and — where you have made it public — let search engines index it and show a preview when somebody shares a link to it. That permission exists so the product can function; it is not a licence to sell your work, sub-license it, or put it in an advertisement.
Delete something and that permission ends with it. Copies may sit in backups for a short period, and anything already indexed elsewhere is out of our hands.
What not to do here
- Post anything unlawful, or anything you do not have the right to post — a book's full text, a screenplay, somebody else's photographs.
- Post slurs, or content that attacks people for their race, ethnicity, nationality, religion, sex, gender identity, sexual orientation or disability.
- Harass, threaten, stalk or impersonate anybody, including the people named in a review.
- Post somebody's private information — an address, a phone number, an email — without their consent.
- Post sexual content, or content that promotes violence, self-harm or terrorism. Writing about how a film, show or book depicts these is fine. Sexual content involving minors is reported to the authorities.
- Use reviews, replies, lists, bios or names to advertise or sell anything.
- Post the same review or reply over and over, or writing that has nothing to do with the work it is attached to.
- Game the site: fake logs, bulk or automated follows, likes and reposts, scripted play in the games, or imports of a history that is not yours.
- Scrape, hammer or otherwise try to break the site, or work around a block, a privacy setting, a suspension or a rate limit.
- Use somebody else's account, or make accounts to evade a suspension.
We have no tolerance for objectionable content or for abusive users. Some of it — slurs — is refused before it posts. The rest is up to the tools below, and to us.
Two tools exist for dealing with other people. Blocking is immediate, in your hands, and severs the relationship both ways. Reporting tells us about something — any review, reply, list or member; it is a record for a human to read, and it does not itself remove anything. Every report is read, and we act on the ones that break these rules. If you need something gone now, block.
We may hide or remove content that breaks these rules, and suspend or close accounts that keep doing it. An author can always delete their own writing, and can delete replies left on it.
If something here is yours
If you believe something posted on spooled infringes your copyright, email help@spooled.me with "Copyright" in the subject line. To act on it we need:
- your name, address, phone number and email, and your signature — typed is fine;
- the work you say is being copied;
- where it is on spooled — a link is best;
- a statement that you believe in good faith the use is not authorised by you, your agent or the law; and
- a statement, under penalty of perjury, that what you have sent is accurate and that you own the copyright or may act for whoever does.
We will take down what we reasonably can and tell the person who posted it. If your writing was taken down and you think that was a mistake, reply to the email you get from us and say why. We close the accounts of people who keep posting other people's work.
Our side of it
Browsing, your diary, shelves, lists, writing, search, recommendations and export are free, and they stay free. If a paid tier ever exists it will sell conveniences around the edges, never access to your own records.
Nothing on spooled is for sale today. If that changes, the terms of any purchase will be set out before you are asked to pay for anything.
If you use the app
You may install the spooled app on devices you own or control and use it under these terms and the rules of the store you got it from. You may not take the app apart, copy it, or use it to build something that competes with it, except where the law lets you.
These terms are between you and us, not Apple or Google. We are responsible for the app and for supporting it; Apple and Google are not. If the app fails a warranty the law gives you, you can tell the store and it may refund what you paid, which is nothing — beyond that, the store has no warranty obligation. Any claim about the app — that it does not work, breaks a law, or infringes somebody's rights — is ours to deal with, not the store's.
By using the app you confirm you are not in a country under a US government embargo, or listed as a "terrorist supporting" country, and are not on a US list of prohibited or restricted people. Apple and Google, and their subsidiaries, may enforce these terms against you as far as they apply to the app.
Other people's data
Film, television and book information comes from third parties, and the catalogue is theirs rather than ours. What they require, and what we can promise about their data, is set out on the Legal page.
Links out to other sites are exactly that. We do not control what is on the other end and are not responsible for it.
Leaving
You can delete your account at any time, from Settings on the site or in the app, and we will not make it difficult — see Privacy for what that removes. We can close an account that breaks these terms. If we close yours and you want your data, ask and we will send it.
The part every site has
spooled is provided as it is. We do not promise it will be uninterrupted or error-free, and we do not warrant that the catalogue is complete or accurate — much of it comes from other people, and some of it is wrong. To the fullest extent the law allows, we are not liable for indirect or consequential losses, or for lost data beyond what we can restore from backups.
None of this limits anything that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Where you have consumer rights that these terms cannot override, you keep them.
Changes, and which law applies
We may update these terms. If a change materially affects you we will say so on the site rather than swap the page out quietly. Carrying on using spooled after a change means you accept it.
These terms are governed by the law of the State of North Carolina, and the state and federal courts in Wake County, North Carolina have jurisdiction over any dispute — without taking away any protection you have under the mandatory law of the country you live in.
